TERMS AND CONDITIONS
OF BOOKING
Please read carefully. Ver11.02.08
Any
booking or enquiry made, presumes that you have read and
agreed to the following terms and conditions which apply
to all bookings unless varied in writing by this office.
Bookings are not residential tenancies, and are not regulated
under the Residential Tenancies Act 1989. They are holiday
licences to occupy short term accommodation, and as such
are exempt, and regulated under Australian common
law , and the terms below. No GST is applicable
on rentals of private residential accommodation such
as these apartments.
1. All bookings are quoted in AUS$ and are payable
in cash, travel cheques, MASTERCARD, VISA or EFT bank transfers.
Cheques are accepted only when paid 7 days in advance and
cleared by the due (or arrival) date. No AMEX/DINERS
2. A cleared deposit of one weeks
rent or minimum $1000, together with written confirmation
from us, is required to establish a booking. If the booking
is canceled less than 14 days prior to arrival, the full
deposit is forfeit (at our discretion). See note 5 below
for cancellation terms.

Any alteration on the original booking, requires 14 days
notice. Bookings may be extended only when there is no follow-on
booking , cancellation or curtailment requires 14 days notice(note5
below). We guarantee that if a property is unacceptable
due to misrepresentation, cleanliness, or another factor
which clearly would prejudice normal occupation, immediately
on arrival (without occupation ),a full refund will be made
of all money paid, without any further liability. Any occupation
of the property (overnight or longer), will constitute an
establishment of the booking, and cancellation terms will
apply. If a property becomes non-habitable for any reason
beyond the tenants control, the agent, at his absolute discretion,
may substitute other equivalent accommodation, or refund
all monies in hand. Maximum liability in any and all cases,
is only to refund all monies and deposits held.
4. On
arrival:- for bookings of under 28 nights, the full
balance is payable. For longer bookings, we require two
weeks in hand (the notice period), and monthly in advance.
Also on arrival a minimum
$1000 deposit/or
credit card authorisation is
required as a security/cleaning deposit, This
may be increased for some bookings/groups.

who will occupy. We do require the leader of the group to
sign a holiday agreement on check-in.
Corporate/Company bookings
are also payable on or before arrival . Overdue invoices:-
interest charged at 2% per month.
5.
Cancellations Any pre-paid amount is 75%
refundable if a booking is cancelled
with 28days + notice. 50% refundable if cancelled between
14 & 28 days notice. Forfeit (no refunds) if cancelled
with less than 14 days notice. This may be varied only at
the agents absolute discretion .
6. In the case
that any booked property is unavailable or uninhabitable
for any reason, we will endeavour
to substitute equivalent accommodation. If we cannot supply
this, or the original or substitute accommodation is not
suitable for any reason, a full refund of all moneys paid
will be made. Our maximum liability
in any case , is only to a full refund of all moneys
and deposits paid to date.
7. No shows
will forfeit their deposit and lose the right of occupation
by 16.00hrs on the day after the original confirmed
arrival date unless they have contacted the office to make
alternative arrangements.
8. There is
a maximum occupation on your
confirmation. If there are extra persons occupying
the accommodation without written consent from the
office, your booking may be immediately cancelled,
and you are liable to forfeit all deposits and payments
up to the 14 days notice period.
9. If any unsuitable or
rowdy behavior in the accommodation, or public and
common areas, causes damage or disturbances
to other residents, you may be given immediate notice to
quit, forfeiting all deposits and payments up
to the 14 days notice period, plus the full costs of repair
and/or replacement of all such damage and repair.
10. We accept normal wear and tear on the accommodation, if however, there
are damages
due to, but not limited to, (or
excess cleaning required), cigarette burns and marks, damage
and stains to soft furnishings, broken crockery and glass,
damage due to careless or mis-use of any equipment,
or fittings, forced entry by tenants, etc..
we reserve the right to deduct the costs of these from any
deposits held, and to receive, from the client, further
damages should this be necessary.
11. We are not responsible for lost
keys or lockouts. It is the tenants responsibility
to arrange and pay for a licensed locksmith to gain entry
to the accommodation if keys have been lost. If you do not
use ESS Locksmiths of Randwick, you will also be charged
at cost for replacement of the lock + 6 keys to our original
specification. We are available during normal office hours,
and may be, but do not guarantee, availability at
any other time to replace lost keys. If security keys are
not returned, we will deduct the full cost of new
keys and lock barrel replacement, from deposits held. The
units are individually managed, we do NOT have a reception
in each block, contact is through our office during normal
business hours. If any window is broken to gain access,
you will be charged for the window at replacement cost.
12. We do not insure guests personal
belongings, also our own losses due to guests leaving
open windows, doors etc which is not covered by our insurance
policies, may be recovered from the guest responsible.
13. No pets of any kind
are allowed in the accommodation.
14. We ask that
tenants leave the units in good clean condition, and that
they replace any furniture or beds which they may have moved.
We also ask that you clear out the rubbish to the local
bins, and that dishes and plates are washed or left in the
dishwasher prior to departure. Failure to leave the units
in clean and tidy condition will result in extra cleaning
fees being levied.
15. Parking is strictly limited to the space/s
provided with the accommodation NO PARKING in any other
spaces.
16. Guests are responsible for taking their own bagged
waste to the proper receptacle in the block.
Pleae Note that we no longer supply telephone
lines in the units as at March 1st 2008. We do have prepaid
mobiles for your use if required..please book these in advance
and you will be advised of the costs.
17. Check in from 14.00 hrs ( 2.00 pm)
Check out before 10.00 hrs ( 10.00am) DATES
ARE NOT INCLUSIVE - CHECK OUT IS AT 10.00 am ON THE
FINAL DATE ON YOUR CONFIRMATION SHEET . LATE CHECKOUT FEE
is $50 PER HOUR. These times may be varied only in writing
by the office, verbal confirmation is not sufficient. Please
note that if you book for the 1-15th June (ie 14 nights)
you depart 10.00am on the 15th.If you wish to check in early,
we may request that you book from the previous day. Please
check with us if this is required.
